German state Considers Criminalizing Denial of Israel’s Right to Exist

(MENAFN) In the German state of Hesse, lawmakers are preparing a proposal that would make it a punishable offense to deny Israel’s right to exist, according to reports.

The initiative is being advanced by Hesse’s Prime Minister Boris Rhein alongside Justice Minister Christian Heinz, with plans to formally introduce the draft legislation on Thursday.

Following that, the proposal is expected to be brought before Germany’s federal upper chamber, the Bundesrat, on May 8, although additional specifics have not yet been disclosed.

The idea has sparked criticism from opponents who argue that such a measure could be used to suppress broader forms of criticism directed at Israel.

A similar request for introducing a new criminal offense had already been made by the Hesse Justice Ministry in 2023, including concerns related to statements made on social media platforms.

At present, German law does not classify questioning Israel’s right to exist as a criminal act.

However, while authorities in Germany have imposed significant limitations on pro-Palestinian expression, recent court decisions have emphasized that freedom of speech protections still apply within certain boundaries.

Following the events of October 7, 2023, when Israel launched a major military campaign in Gaza, Germany has witnessed large-scale demonstrations opposing Israel’s actions in the territory amid widespread accusations of severe violence in the enclave.
